**FIRST – GOVERNING LAW**  

Supreme Q Racing operates as an independent contractor conducting equine sales and does not hold ownership interest in consigned horses unless expressly stated. All sales are conducted in accordance with the laws of the States of Utah and Wyoming, and all transactions between buyers, sellers, and Supreme Q Racing shall be governed thereby. ALL HORSES ARE SOLD "AS IS, WHERE IS" WITH ALL EXISTING CONDITIONS AND DEFECTS. There are no warranties, express or implied, including but not limited to fitness, soundness, merchantability, or suitability for any particular purpose. It is solely the buyer’s responsibility to inspect and verify the condition and suitability of any horse prior to purchase.

 

**SECOND – BUYER’S PREMIUM & PAYMENT TERMS**  

A 3% Buyer’s Fee will be added to the final hammer price and is due at the time of sale closing. Full payment must be arranged within three (3) calendar days of the auction’s close. Failure to do so will result in default and possible resale of the horse at the buyer’s expense. Acceptable forms of payment include wire transfer, cashier’s check, or other verified funds. Personal checks will not be accepted unless pre-approved.

 

**THIRD – BIDDING PROCEDURE**  

The highest bidder acknowledged by the auctioneer shall be the purchaser. Bidding disputes shall be resolved solely at the discretion of the auctioneer, whose decision shall be final. Consignors reserve the right to bid on their own animals and to set minimum acceptable prices.

 

**FOURTH – ONLINE & PHONE BIDDING**  

Supreme Q Racing may offer bidding via online platform. Bidders intending to participate online or by phone must register and be approved no less than 48 hours prior to auction start. Supreme Q Racing is not responsible for internet connectivity issues or failure to process a bid.

 

**FIFTH – TITLE, RISK & DELIVERY**  

Title and all risk of loss pass to the buyer at the fall of the hammer. Buyers or their agents assume full responsibility, custody, and care of the horse immediately following purchase. Supreme Q Racing assumes no responsibility for injury, illness, theft, or death of any animal once sold. Transportation must be arranged within seven (7) calendar days following the sale. Horses not picked up within that time may incur additional board and care fees at the discretion of the facility or consignor.

 

**SIXTH – DEFAULT & REMEDIES**  

In the event of buyer default, Supreme Q Racing reserves the right to resell the horse publicly or privately without notice, and the defaulting buyer shall be responsible for all deficiencies, legal fees, resale costs, and other associated expenses. Any legal dispute arising from the auction will be handled in accordance with the laws of the State of Utah or Wyoming, depending on where the sale took place.

 

**SEVENTH – WARRANTIES AND REPRESENTATIONS**  

Except where specifically stated by the auctioneer or consignor at the time of sale, there are no warranties or guarantees. Buyers are strongly encouraged to conduct pre-purchase exams and due diligence. No guarantees are made regarding training, soundness, temperament, breedability, or eligibility for registration.

 

**EIGHTH – REGISTRATION & DOCUMENTS**  

Where applicable, registration papers will be transferred only after full payment has been received and cleared. Supreme Q Racing is not liable for delays in registration transfer resulting from breed associations or incomplete paperwork from the consignor.

 

**NINTH – MINIMUM RESERVE PRICE & FINAL RIGHT OF SALE**  

Supreme Q Racing reserves the right to set a minimum reserve price on any horse offered for sale. If the bidding does not reach the established reserve price, the horse shall not be sold. Additionally, Supreme Q Racing retains the final right of sale, meaning that the auctioneer may refuse to finalize a sale at their discretion, even if the bidding reaches or exceeds the reserve price. This discretion includes, but is not limited to, concerns regarding the legitimacy of bids or compliance with the auction terms.

 

**TENTH – FINALITY OF SALE**  

All sales are final. Once the auctioneer has dropped the hammer, ownership changes hands. Supreme Q Racing does not mediate disputes between buyer and seller once a sale is finalized, except in cases of fraud or material misrepresentation made publicly at the time of auction.
